Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Picfony ("Picfony," "we," "us," or "our"), governing your use of our websites, applications, and related services (collectively, the "Service"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy.   • You retain all rights to photographs, images, text, and other content you upload to the Service ("User Content").
  • By submitting User Content, you grant Picfony a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, display, reproduce, and distribute such User Content solely for the purposes of providing the Service.
  • You represent and warrant that your User Content complies with all applicable laws, including data protection and intellectual property laws, and does not infringe the rights of any third party.
5. Data Protection and Privacy

As a data subject, you have rights under the GDPR, including the right to access, rectify, erase, restrict, or object to the processing of your personal data, as well as the right to data portability and to lodge a complaint with a supervisory authority.

6. Acceptable Use
  • Do not upload or share unlawful, defamatory, obscene, offensive, or abusive content.
  • Do not infringe the rights of others or upload malicious code.
  • Do not attempt to access unauthorized areas of the Service or disrupt its operation.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Cyprus. Any disputes shall be resolved exclusively in the courts of Nicosia, Cyprus.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated, and your continued use of the Service constitutes acceptance of the updated Terms.

14. Miscellaneous
  • Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Picfony regarding the Service.
  • Severability: If any provision is deemed unenforceable, the remaining provisions will remain in full force and effect.
  • Waiver: Our failure to enforce any provision shall not constitute a waiver of that or any other provision.
  • Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms freely.
